I haven't seen any American case law on the matter, so right now it's a gray area. It's sure to pop up in the court system as deep fakes get easier to make and higher quality.

I can't find a source offhand, but I remember reading something like most DMCA requests pertain to porn or that most egregious DMCA requests pertain to porn.

Porn companies are hesitant about taking a case to clear up the matter to the SCOTUS because of the risk of getting an unfavorable decision. They typically prefer to settle a matter like this out of court.

This is also one (of many, but not germane to this discussion) why there's basically one company that has a monopoly on the industry. At first glance you'd think that MindGeek owning production companies and websites that give away their content for free doesn't make much sense.

The racket they have going on is they'll pressure a porn aggregator that gets popular with their lawyers and then offer to buy them. That way they're not wasting money taking a case to the SCOTUS for a ruling on copyright that may not be in their favor. They also get the added bonus of now owning the popular aggregator that distributes their content for free. They capitalize on ad revenue and having the advantage of being a monopoly in a seedy industry that most ad companies and payment processors want nothing to do with. They already have that infrastructure in place. No one is going to get a better ad deal or payment processor rate than them.

Finally, they will start to minimize the amount of full length videos on the aggregator, Especially for videos made by their production companies rather than the few porn studios they don't own. Then they'll offer a premium account option that allows a desperate coomer who's about to bust a nut (but wants the full video) an easy option to sign up and see it.

Unrelated, but that Medium article has a funny quip that summarizes why MindGeek is a terrible company regardless of all their other shady business practices.

There are some funny aspects of MindGeek as a result of them trying to put on a “non-porn” image (ala their website). If you look at their GlassDoor reviews, you’ll see people say things like “If you’re interested in the ‘Content Formatter’ job, just be aware you’re basically a glorified child porn screener, and you will be watching disgusting videos all day.” They have a solid 2.9/5 on GlassDoor.
