I remember he was saying he was representing the debt because apparently he bought the debt for fraction of the original debt which is a thing. I dont remember the details but I think he never said he represented Midfirst but represented the debt from Midfirst, I could be wrong. I think the guy might have been bsing to be a debit buyer, either way it was a funny stream seeing the BS that Phil pulled with the court. Love how he claimed his PS Vita as a business expense but he never played it once on his channel. Shit like this just proves even further he is a lying scummy person. Never change Phil.

Yeah, I think Morty got the wrong creditor. I believe the accurate lore is that this guy bought one of Phils delinquent credit card debts from CitiBank, not the MidFirst mortgage.

If I remember right, there was some initial confusion over if he was representing CitiBank specifically, and he did a short stream to clarify that he wasnt (among other details)

He lies on his tax return by including WWE Champions spending as a business expense so on paper he only earns $5k a month.

This is clear on his bankruptcy paperwork.
I could have swore that it was figured out what he owes in taxes lines up with his actual income, not with his pretend income. After all, that would explain why he's not in fucking jail by now for tax fraud.

Unless the IRS audit his game schedule with his expenses (and actually notice he never plays mobile games as part of his business) he won't be caught.

I'm fairly sure he only owes this much in tax as he went years without paying it too.

Yup, his profit margins probably look perfectly reasonable for any typical small business. The IRS wouldn't expect him to have barely any expenses and secretly piss all that extra money away. It's not like he's cleverly stowing money in a vault! He's actually spending it and not by accumulating wealth through luxury items.

Nothing yet, the hearing was two and a half hours ago and I have it set up to receive email updates and the last couple of times I got said updates they were in the afternoon leading me to believe they don't update until the end of the day and someone has to babysit the upload.

Exactly, I mean I'm almost certain this sort of thing took as long as the bankruptcy hearing it was probably just a matter of semantics nothing more "you're ok with this? You're ok with that? How much was this at this time etc." yeah pretty sure it's all over by now if it was delayed we probably would have heard already.

If you're correct, then we know what he'll be begging extra hard for pretty soon. What makes this more enjoyable than it normally would be is the fact that 1) it cuts into his gacha spending, and 2) he doesn't bother to have a savings for this kind of shit, so there's never a way for him to still "win" despite losing. He just straight-up loses, thanks to being shit with money.

This appears to be correct. The bank is making a very clear distinction between the deficiency on the property and the fees associated with this case and they are trying to collect those fees immediately. At the risk of sounding like a broken record I'm not sure whether this the fees are enforceable either but it would be really weird to go through all this trouble unless they plan to collect.

The other thing a real attorney like AnOminous would have to explain is how much liability the condo board has here. The docket entry lists "Philip Burnell" and does not mention the condo board or include "et al" to note that there were too many parties to list, but the condo board is mentioned on the docket and in the Law Days. I honestly don't know what this means or even if it was legitimate vs. an oversight by the bank or court.

The other bit of interest is list of Law Days on page 3. The law day for Phil is irrelevant because law days relate to buying a property out of foreclosure and he intends to surrender it, but MidFirst will take possession of it on 29 July; I am assuming the condo board is listed for completeness and does not intend to buy it. This will end Phil's obligation to pay $400 and change in monthly HOA fees -call it a hunch but I expect this to be accompanied by a sudden spike in activity from Definitely Not DSP in WWE Champions.

It makes layperson sense to me that the $20,000-ish deficiency would probably be covered by the bankruptcy, but the fees wouldn't. They were assessed after the bankruptcy on a case that was rather tangential to it, and primarily due to Phil utterly ignoring a court proceeding. Or being dumb enough to legitimately think that he actually granted "permission" for the foreclosure and that ended it.

Not to defend a bank (they're no more deserving of that shit from me than Phil is), but TBH, were I a bank, I would probably save myself the hassle and just call us even after all the money he has already given me thanks to a high interest rate. I know a combative person when I see one, and I would see it with Phil even if he weren't "DarkSydePhil" to me. You can't squeeze money out of him without going through a lot of trouble, but you can let him hand it over with his own stupidity.

Besides, it's also obvious that he'll be back to having lines of credit eventually, if he doesn't already, given that he lost those two Twitch checks. Yes, I know he has been raking it in, but this is Phil. The more he gets daily money, the more days he spends it all, and without that cushion, he's surely having to either go without certain things (I mean paying bills on time, not stuff he wants, because he doesn't prioritize properly), or put shit on credit. And I seriously doubt he's actively avoiding lines of credit with any of the banks he owed money to, because there were too many of them for that to be feasible anyway.

Yeah, that makes sense looking back. Which is probably the same thing a lot of us will say when he gets out of paying awarded court fees.

Looking at it in that moment, though, it seemed like at least one of them would have known what a streamer is and wanted a deeper dive into how a relatively obscure one was spending that much money on it. Especially if they pulled up Twitch or YouTube to actually watch Phil. Or hell, even said, "Huh, you make $10,000 a month with $5,000 personal expenses and $5,000 business expenses. That's suspiciously convenient."

It's not like it matters, anyway. Even if Midfirst can compel him to pay the fees and he doesn't pigroach his way out of it, some sped will roll in and give him the money.
