Oh you happy optimistic fool! Never count out Wu's ability to turn anything into a clown show.
I can't wait for Wu to lie down in a puddle of fake blood in a cruciform position in the middle of the court room while monologueing about how the violence of Alex Jones fans on the internet did this.

this is a meme but i could actually see wu going off on a rant about gamergate on the witness stand in front of the judge and jury
that would be great fun

Right. If you look at the top of the article, below the headline, it says: "Updated 11:20 am EDT, Thursday, August 22, 2019". Wu tweeted the article in mid-June.

I must've looked for the wrong page before on archive.org, though, since I did find an archive from June 17, which does say,

"The law firm representing the families of the 2012 mass shooting, stated in court documents filed Monday they have contacted the FBI after discovering child porn in electronic files Jones recently turned over to the Sandy Hook families as a result of their lawsuit against him for calling the tragedy a hoax."

The title also says "Lawyers: Alex Jones sent child porn to Sandy Hook victims families". I think it's safe to assume that the people at CT Post realized that needed correction since it was clearly inaccurate, given that they changed it. I'd guess that probably works in Wu's favor. The death threat part is still a bit dodgy, since he did arguably make death threats, though the target directed was incorrectly identified by Brianna Wu in the tweet.
It seems she might be covered by section 230 then. TYT might not be. Does section 230 cover republishing info if the original source isnt included?

I dont see this turning into a shitshow just yet if Frank is holding the purse strings. Frank has always been Wu's fixer and hes somewhat decent at it. He will probably control what lawyer Wu gets. But if this does get to discovery and depositions then absolutely expect a shitshow especially if Wu doesnt do any deposition prep. Wu ill either have to admit to all the lies shes told or straight up perjure herself. Assuming Alex Jones lawyer knows to ask about all that stuff.

John actually did retweet the original article, and yes, it would cover it in California at least. Maybe in Massachusetts. Possibly in Texas. Not sure which state's laws would apply.

It wouldn't cover The Young Turks regardless, since they were producing content, not republishing someone else's. Unfortunately, I haven't seen the video they made; they took the video down before anyone on here could download it, AFAIK. So I couldn't tell you what kind of case Jones has against them. I will tell you that TYT has a long, long history of getting into it with Jones, though I don't know if that makes it more likely or less likely that his claim has merit.

They had a banner at the bottom of their feed explicitly stating that Jones had sent pornography, and Ana Kasparian went off on a long tangent and showed great creativity in the various ways that she slandered Mr. Jones.

Yeah, that sounds pretty much how I would've expected it to be. Their beef with Jones goes back for years and years; obviously there was the time Cenk almost got into a fight when Jones and Roger Stone showed up during the RNC, but they've used him as an easy punching bag forever. I feel like they got less humorous about it and more venomous after the election, but pretty much everything about the show got more venomous after the election.

So TYT are definitely going to discovery right? As a media outlet do they have a bigger barrier to get to discovery?

Wu is possibly in because threatening to kill the Sandy Hook lawyers wasnt a part of the original article and she doesnt have media protections.

What about Andy Kimmel? I dont even know who that is and I dont think what he did has been discussed in this thread.

There is no guarantee that they will pass jurisdictional tests or any anti-SLAPP statutes that may apply, so there's no guarantee for discovery at the moment.

I voted your post optimistic because I'm not sure he or Jones care about that tbh

Jones doesn't have the same motivation as most people who are excited about this suit--that is, to see something like you describe, to see Wu destroyed in general. So why would his lawyer have that motivation.

Because it would absolutely destroy the jury's view on them. Wu could be entirely in the right, entirely factually correct, and that does not matter if the Jury hates their guts.

As @AlexJonesGotMePregnant pointed out, there's still no guarantee that TYT will go through to discovery. I would suspect they probably have the worst chance of getting out of it.

The death threats, such as they were, were actually in the original article. Wu just misidentified the target referenced in the article as being one of the Sandy Hook parents, rather than their lawyer. There's potential there, but honestly, I suspect that could go either way.

As to Kimmel...Andrew Kimmel is a producer/director that worked TV and Buzzfeed Video. He currently works for some company called AuraNexus that does...something? I couldn't figure it out from their site. He is literally never referenced in the text of the complaint. Nothing he did is mentioned at all. I have literally no idea why he's even included in the lawsuit, and apparently according to his Twitter, neither does he. I think it goes without saying that this will probably not go anywhere as it stands.

The complaint does reference Mark Follman, who is the National Affairs editor of Mother Jones magazine, but apparently he isn't named as a defendant? I dunno; I think Alex Jones might have himself a LOLyer here.

>the jury

I doubt Jones/his lawyer expect or even want it to get that far
(and yes, i know, "jury TRAIL demanded". that doesn't mean that it's ultimately what jones really expects to happen or wants to have to pay for)

That doesn't mean you don't play to what a Jury would use. In fact, it means you very much DO. The more likely a Jury is to turn on you, the more impetus you have to settle. Even if your plan is to never set FOOT in the courtroom proper, you set up everything like you do because it puts pressure on the opposing party.
