This was just posted on /v/ in a thread about the recent stuff. Seems like Karl was running a dating advice / pick-up artist website in the past, which he mostly scrubbed from the internet since then?

Apollo specifically cites his friends betraying him, and depression from chronic pain.

The way he phrases that the financial burden lead him to take his own life sounds defamatory to me. Correct me if I'm wrong IANAL. Him cutting out the segment without any announcement isn't not a very good look for him.

I'm well aware Billy is a big liar but I think Karl screwed up significantly by even mentioning this. It was a very good way to rile up the crowd however.

He and EZScape are very good at that.

Elements of defamation are:

1. False Statement Purporting to be Fact
2. Publication of that Statement to a Third Party
3. Fault
4. Damages

The potential defamation here isn't attributing Mitchell as a factor in Apollo's suicide, it's the "factual" reason Jobst claims to support his belief. The problem with basing a defamation claim off of Jobst's comment that the debt and health issues were "all too much for [Apollo], and ultimately he took his own life" on its own is that such a statement regarding Apollo's motivations is not a subject to falsifiability (i.e. can be definitively proven false as a fact). The only person who could reasonably know for certain Apollo's reasons for suicide are Apollo, and he's dead, notwithstanding any writings he made detailing his motives. Even with a detailed suicide statement, we are not privy to the inner machinations of Apollo's mind, and his motivations for taking his own life aren't something that are falsifiable. We can't open up his skull and find the truth in there.

The real meat of a potential defamation claim is the other half of the statement: Jobst's claim that Apollo paid Mitchell a large sum of money in the settlement. That is something that is subject to being proven false. Look at the settlement document: either Apollo agreed to pay Mitchell money or he didn't. If he didn't, like Mitchell states, Jobst made a false statement. Jobst's reliance on an unverified source shows potential negligence on Jobst's part to properly check what he was saying was true. Even so, there are a lot of ways Jobst could potentially defend against a defamation claim.

One thing that's weird is that Mitchell does not deny the portion of the video where Jobst accuses him of laughing at Apollo's death. You would think that he would provide some rebuttal for that, but he doesn't, which leads me to conclude the screengrab Jobst provided was genuine.
