They can still dismiss his complaint, even if they'd ordinarily find in his favor, if they think it's been brought will ill-intent.
Hand in hand with @GargoyleGorl stated, Member Cousineau found that Yaniv was acting in bad faith with the first set of complaints. Between dropping complaints when the respondents sought legal assistance and making disparaging, racist remarks about a number of the respondents (who were largely natives of India or southeast Asia that immigrated to Canada), Cousineau felt Yaniv's complaints weren't entirely motivated by a bona fide need to right a wrong and involved Yaniv behaving in an equally inappropriate way towards the respondents -- something the human rights tribunal couldn't overlook if it wanted to maintain any semblance of credibility.

If Mr. Cameron can establish this complaint was also made in bad faith, it could end up dismissed like the others. One also hopes that the fact alternatives were proposed (yet rejected by Yaniv) shows that this specific respondent wasn't behaving in a discriminatory manner that needs to be addressed by the HRT in spite of what Yaniv, Oger, and others may think.

I wouldn't be at all surprised if this salon had been forewarned by others, I'm sure they communicate to some degree. Fuck off, Yanny.

The news coverage of the previous case has no doubt helped spread the word about this gender cosplayer and his bigotry, too. I guarantee these shops talk to each other or they have some kind of professional society or association that keeps tabs on trending news that can affect their businesses. Yaniv is now a poster child for abusive behavior that these salons will be wary of.

Yes, he's only targeting forruns again. Yes, he only did it because he wanted to take it to tribunal, and having lost the last case he wants to punch everyone in the face metaphorically and win his right to make people wax him somewhere. And not, he doesn't actually want his legs or any other part of his anatomy waxing (he could do it himself at home if he was that desperate, ffs), he just wants to cause trouble. And this is an easy way to get another hit of being everyone's most hated fat pedo in a dress.

As Ronan Ogre pointed out, the legal case about waxing troons is one they want to push in Canada. This is a new try at eating away the protections businesses have from weirdo litigious perverts like JY. If he can get the court to rule in his favour about leg waxing, he can demand as many forrun women wax his legs as he likes, whether or not they say they only do real women, their husbands won't let them, or it's against their religion. And I have no doubt that if he wins this case he'll do exactly that - not because he wants his legs waxing (oh, he'll ask for arms and chest and butt too, I'm sure) but because he gets off on making people deal with him with a fake smile, knowing they're incredibly uncomfortable with it.

(I'd go as far as to say that's the whole reason Jonny trooned out - to force himself on people who can't say no. He has no interest in being female, but if getting attention means getting a full face of makeup done at Sephora, he'll go through with it because it makes his microdick hard that the girl having to powder his face is hating every second of it. He's hardly the only troon, queer or sjw to do this sort of thing)

Tl;dr JY will win this case, because it's not about genital waxing, and men are women if they say so in Canada.
I think you're right about this if it gets decided on the merits. But real judges are crafty bastards and I'm betting HRT posers are too. There's so much publicity on this now, and its a universal embarrassment for everyone involved, that I bet it gets dismissed without prejudice (or whatever term HRT uses) on a procedural issue that Yaniv won't be able to overcome without difficulty. I'll wager Cousineau is coming up with something even as we speak.

Businesses larger than these don't exactly quiver in fear of HRT cases, because the awards are so small. Pay and go.

There are constitutional lawyers (Academics) in Canada trying to figure out how to abolish the HRT. Quietly. Without having their legacy be "destroyed human rights"

These cases are doing a great job paving the way. The tribunal keeps real victims from pursuing actual lawsuits against real criminals while allowing working class people to violate each other using a torturous bureaucratic process.

OK, that's an exceptionally good point. Diabetes makes the skin real dry, and dry skin cracks. And the cracks take a long time to heal. It's a snowball. Waxing takes a huge toll on the skin, like, you gotta exfoliate and hydrate it for 72 hours after the procedure. No sex, no masturbation, nothing that creates friction on the skin.

That for, ya know, healthy, normal people. Imagine for someone with diabetes.

I know that dumb fatso would not take that as an answer, but that could be another good reason in the court. The good reasons not to do the waxing keep piling. Hope the judge sees it.

I’m sure men get erection when woman are waxing their legs as well, being that you are working around the groin area, and the client is in a private room in their underwear. I don’t think you’d need a religious defense to argue that a woman should not be forced into that situation.

Wasn’t one of the defendants in the last round of hearings asked for a leg wax as well?
