Finally something useful on this thread for once. There was a person who goes by the name Sa1bot who owned this CS crap called Minkins? Now in case you wanna know what that looks like? Here it is.

A nice artist going by StePanda drew a nice fanart of this original creature. So what was the problem with it? Well, I'll link you a few things and see if you guys can see the problem a mile away.

It all started with this piece. You will notice it was originally a pare of Minkins. Why were they changed to Deer so fast?

Well, said artist Sa1bot thought StePanda stolen his copyright and was trying to copystrike down online.

So StePanda due to fearing that a lawsuit would go down on her had to make peace with that artist fast by changing the creatures to normal Deers and make fanart for that crybaby user online who claimed he was going to sue her hard for stealing the copyright to the name Minkins. No joke it's fucking gay as hell.

As you can see in the comments of the art link I posted. Sa1bot glees like a fucking school girl thanking StePanda for respecting his copyrighted OS. Like it's that gay as hell.

This was his journal he ended up on his hiatus. But it goes to show you how huge of these lengths these people go to not only to trademark these creatures but even their design as well. Never mind the fact that if you google the name minkins online or just minkin. One on YouTube will show a poker case player who's a chick and the other an Australian Aboriginal language. You will see a problem with this if you connect two brains together.

Like it's so petty for some dumbass to attack a female artist all because she liked two of these fake creatures on Tumblr and never meant to hurt people. I see dainties pop up on my deviantart feed all the time, they're incredibly popular with the "I draw everything in pastels because I'm baby uwu" tumblr artists. I still don't understand how any of this or just the general "adoptables" culture work. What's stopping literally anyone from making an OC that looks like a closed species or a paid adoptable and either claiming it as fanart or that they look similar as a coincidence?
This is so bizarre, it's like if Tolkien went online and had a bitch fit any time anyone made an elf OC.

I don't get how closed species work. How does the creator stop anyone from copying their species without paying? Copyright/ip laws shouldn't matter since Deviantart is full of fan art and nobody bats an eye.

So you're paying $1500 to not have crazy people kick you out of their community and stalk you.

That seems creatively stifling. Every artist gets their start by just drawing art other people made until they grow their talent and form their own style. What a bunch of faggots.

This is pretty much it-- like adoptables, there's really no legal basis for any of the rules, but it's very much community-based peer pressure that enforces the whole thing. For example, 'knockoff species' are a thing that you can find a bunch of drama surrounding, and it's pretty much exactly what you'd expect. You have people, usually trolls, who will make near-identical versions of those popular species that sell for insane amounts of money and then just wait and see what happens when shit hits the fan.

Part of the enforcement comes from the aforementioned everyone-knows-everyone effect, since you piss off one species owner and suddenly their twenty friends who are mods elsewhere have blacklisted you from half of creation. But it's also the sort of thing where all the members of a species have an incentive to stomp out anything that's seen as a threat to the species-- the whole idea is based around exclusivity, and if it's not exclusive then the sushi-cat-bun-floof they bought might suddenly not resell for the $4748595626 they paid for it. It's a self-sustaining problem.

Toyhou.se is a great source looking for these. There’s a ton of drama and butthurt that happen. Typically you’re paying to be in the community more then a design. Aside from an artist getting fans to reee at someone anyone can make a knock off. But then you can’t post your UwU gay boy twink in a group or world and get attention and pretend other people are your friends. The people with hate boners for closed species and go out of their way to sell knock off’s are funny too. That’s not touching on people who make species with “young looking characters” so they can basically fap to imagined underage mpreg. I’ll dig for some funny stuff later.

Most of the things being mentioned would not be copyrightable based on my understanding, but you could maybe get a trademark on some of these. The autistic miles long backstories to these creations actually would probably be one thing that helps their cases more than anything in the art to acquire a trademark. That plus the fact they're trying to defend their creations from others would be key. They've sorta stumbled into an actual legal defense for trademarks through the autism. At least as a layman, that's the route I would see as the most obvious to try to get this into a court, trademark your unique... um... primagen... then sue over a trademark violation.

And definitely don't involve any actual lawyers in any of this, they'll just be negative nancies who naysay.

Shadowmonsters by Piffi-Sisters (also bonus, I don't think their first language is english and they haven't gotten anyone to proofread their 'species guide/lore' for them, making it even more impenetrable than it might otherwise be). These things all have the general look of a gaiaonline avatar covered in absolute pixel vomit.

A nice example: for the low, low price of $1200 you too can make every future artist you commission fucking hate you.

One interesting thing you could mention is the offbrands/closed species revolt. Basically some people make offbrand versions of species, usually because the actual species itself is too hard to get (which most of the time they are because they're so overpriced). Usually they have some sort of generic name like "curly tail dog" or something. it's kind of like generic brands vs name brands at the grocery store

Has anyone else ever been on Chickensmoothie? It’s this website where you can adopt cartoon pets and dress them up, so naturally the forums are full of furries. There’s a lot of adoptable drama. Often the payment is not real money but a rare Chickensmoothie dog or other pet.
I'll definitely look into that, since it seems to be a huge breeding ground for lolcows. Also holy shit, most of these designs are abhorrent.

To them, ™ ® © all mean the same thing; not understanding the differences as to what they denote, what sort of protections (and in what court) they entail, and how to even go about getting one.

When furries and DA speds talk about patenting their art/species, that shit makes me grind my teeth; but it makes me optimistic for the day one actually tries to leverage it on a Judge Judy-type show..... and then both sides get destroyed.

What confuses me about these things are not the people creating them - I respect the hustle - it's who would pay $1200 for the right to draw a sparkledog? What would you even do with it? Think what else you could do with $1200. Even if you don't spend it on, say, a games console with more games than you could ever play, or your first car, or a holiday, even if you were going to be a complete DA autismo trying to flex on other DA autismos, for $1200 you could design your own sparkledog, pay someone to animate a show about it, and get a one-of-a-kind statue of the thing, and probably have change left over. If you did that there's a small chance that someone outside a handful of DA tards would ever see it, too.

Someone who is young enough or low-functioning enough to think that $1200 is a reasonable price to pay for someone else's pixels is surely too young or low-functioning to have $1200 lying around anyway. It makes my brain throw a cog, it really does.

I enjoy making up new monster and charterers in my spare time but i absolutely hate the idea of closed species . Its like the equivalent of having to pay James Cameron if you wanted to make an Na'vi or the Tolkien estate if you wanted to make a hobbit oc.
Also some fans and owners of popular closed species will go after other artist who make a character closed to there precious do not steels.

MTTs are dead but were a massive eyesore and there was plenty of internal drama involving stuff like markings, copying, people leaving, etc. until it fell apart.

Felkins are not a closed species, to my knowledge, but I keep finding them all over FA and they seem to just be like hairier Reons that are used in porn a lot. It was surprisingly difficult to find a SFW reference to post here.

There's already a thread on Adiago, but her Space Drakes definitely qualify here as well; a closed species whose design is ripped from another creator, Adiago will retract ownership if she decides she doesn't like the buyer anymore (no refunds of course). Only giving her a mention here since DADs were brought up.

I feel this thread can also be expanded to include ARPG critters beyond just character adopts; Tokotas, Reons, Esks, etc. all have massive communities and doubtless their own shares of drama.
