It reminds me of what Potter Stewart said in regards to attempting to define obscenity:
I prefer Hugo Black's view of First Amendment protections, which is not that of Stewart "I know it when I see it," but instead, quite simply that the government has no authority to regulate it whatsoever so should not even be inquiring into the subject matter or content of expressive material at all, ever, full stop. In short, "Congress shall make no law" should mean Congress shall make no law.
