Given that Cole left the stuff at 14 BLC for decades and has made no attempt to retrieve it, it is fair to consider it abandoned property. I am fairly confident that he can raise no objection to Chris and Barb selling the stuff.

So if he just sold it as a model rocket, it would be no problem. But I think he might run into problems, if Cole kicked up a fuss, because he is clearly selling it as Cole Smithey's stuff, and trying to extract a premium for that using Cole's name. Although I am not 100% sure about that, because it is Cole's stuff, so Chris is not misrepresenting it, and he obtained it legally, because Cole abandoned it at his house.
