Interesting, I always thought it was legal for minors to drink in their own homes. If the Memphis pig was pouring Maker's Mark down Faith's drain where she clearly didn't like it, that's probably another Class 1 misdemeanor. I wonder how enforced this law is. I can think of those odd specific cases too. Not just 18, 16 is enough for some people to become independent. What if the person was dating a 21yo (legal in many places, 5 years difference is meh to most) and they drank? I guess that would be allowed since the 16yo doesn't have a caregiver/guardian type?

I know it's a bit OT but this is more interesting to me than the overly invested crying about how he's going to get away with it. 21 is the age for unaccompanied individuals to purchase and consume in every state but as shown by some of the responses this gets this misconstrued as being a hard limit. Plenty of states have exceptions and legal ways around it. The issue is that even if it's legal to do, the risk of improperly serving an underage person means it doesn't get done very often. In other words 21 is always safe so businesses set that as their policy whether or not they're aware of exceptions.

A state I lived in allowed something like 18 and up can drink at bars with a spouse or gurdian 21+ and under 18 can drink at home with a spouse or guardian 21+. But to go purchase closed alcohol in a store was always 21+. I'm sure there was a lower limit but frankly didn't care. That being said, the penalty for under age drinking is basically nothing, but providing minors with alcohol can be pretty severe.

Also there was a time when the laws kept changing on all the legal 18 year olds who basically got the rug pulled out from under them every time the law changed. I recall hearing about a time where the law made it illegal to buy but didn't impact possession and a university confiscated and destroyed the 18 year-olds legal booze. There was a legal case about it but I didn't remember what remedy the students got. I remember it was an issue because the legal alcohol was invaluable as the monetary replacement of a 6pack doesn't make it so that the students are made whole (they can't go buy a new 6pack and the value it had was because it was a lawful 6pack)

To sum it up the exceptions are pretty much either for religious consumption or under the control of your own parent. If it's just some person you're not related to it's not legal. A legally emancipated but unmarried person is probably SOL based on the exemptions I've seen before.

I'm not a lawyer, so this isn't legal advice, but I think the problem you would have relying on the video alone is that it would not be difficult to undermine it's veracity. So more solid records - such as those available on his phone or held by Instagram - that can't be editted would be a surer bet.
