So dumb, if an employer cares about that than a Google search will show everything. Using his logic it’s like googling someone’s name to see they were a member of an some neo-Nazi party but when questioned about it they turn around and say “oh no I haven’t been associated with them for over eight months!” Oh then never mind welcome aboard!

Lots of ums and uhs, and when he tried to make a point he didnt seem to understand what talking order was, so he would hear the judge say that something was wrong about what he said and cut him off with "bu-but sir" until the judge explicitly told him to stop. He also had a habit of getting halfway up from his seat whenever his claims were attacked, but then sitting back down or hovering over the seat.

Considering that this was the case which exposed his fraudulent, ethics breaking ass and has resulted in a website exposing him as the worst lawyer possible at the top of the google searches for "Kevin Landau", it's no wonder he wants to get away as fast as possible.

Not surprised at all. Things like this slide all the time in civil cases. Folks have this image of judges as infallible arbiters following the law to a T and eager to wax on for dozens of pages in opinions on any issue like they're on the SCOTUS. In reality, many of them are lazy shits and are often unwilling to stick their necks out on something that is likely to be put under a microscope on an appeal (which anything involving attorney sanctions is almost certain to).

It's abuse of discretion. Trial courts have broad leeway in making the decision. Frankly, though, if the description of the feckless disregard the judge showed for the actual legality of anything involved is accurate, I think it is an abuse of discretion to deny sanctions effectively just because he's bored.

The unlikelihood of success is why it's unlikely to be appealed. You'd be throwing something like ten grand at it at a minimum, maybe somewhat less if you got some academic wonk with an interest in the subject to help out as an amicus or otherwise, and maybe have a 25% chance of success (wild ass guess). You could spend much, much more for some white shoe firm. That may actually be optimistic because the decision was frankly so obviously dumb and the judge didn't appear to apply any legal standard at all.

Honestly, if sanctions aren't applicable in this case, I'd like to know when they'd be applicable at all in New York State. They ought to just get rid of the rule and say the new rule is pure Clown World litigation and you can do anything, even commit crimes, in the course of litigation and absolutely nothing will happen.

And if you "won," the result might simply be a remand back to the same dipshit who fucked it up in the first place, with a remand order to do it over and actually apply a legal standard this time, whereupon this feckless dick would be forced to write an opinion explaining his "reasoning."

I think Asterios should have Greenberger do this. I know it is the sunk-cost fallacy but if the judge says "yeah, go ahead with the perjury thing," I would do it. Maddox would have to travel to NY from CA (again), which will put a strain on his finances.

Landau’s dad wasn’t in court, at least not when I was there. I believe this is referring to the letter his dad sent Greenberger in an attempt to get Greenberger to drop the sanctions a while back. Obviously, it didn’t work.
