Massachusetts has a harassment statute.
They do. What @waffle was getting at was that they haven't made harassment a tort where the Plaintiff can recover damages. That statute only has injunctive relief (and of course, criminal sanctions for violating the court order).
But, as I pointed out, even though MA doesn't allow recovery for harassment, invasion of privacy as a statutory tort in MA can be easily twisted to cover a lot of harassment (cf. this).
Edit: I'll leave what I wrote up because I was a moron, but yes, you're right the statute does allow for recovery of actual damages. I didn't bother to read it thoroughly (and apparently was similarly remiss in my cursory review on Westlaw earlier). I really do suck.
Maybe I should just move to Omaha and start slinging those cinnabons . . .
