No, that's still legal jeopardy. The one exception is if the defendant was never in jeopardy because he bribed the jury or the judge, like Harry Aleman. Generally, jeopardy attaches from the very moment testimony is taken at trial. The way prosecutors get to appeal is they appeal during trial, because they otherwise couldn't afterwards. There are also a few pretty rare occasions where prosecutors can appeal a final trial court decision, such as when the judge actually overturns the jury conviction and awards a new trial, or when the defendant deliberately causes a mistrial (usually pretty difficult to prove).
