Megathread Jonathan Yaniv charged with death threat crimes against Chris Elston. -

I found it interesting that the RCMP thought Johnathan tripped the fire alarm. I wouldn't be surprised if he did something destructive some day to make the threats he claims to receive seem credible and make him look like a victim who the RCMP didn't take seriously.
the description of this incident is wonky. He supposedly didn't hear anything because he was not using his hearing aid (is his hearing loss even legit?), and he couldn't have tripped the alarm, because he lives on the 2nd floor, and there is no way for him to be on the 4th floor. Like, use your staircase or something. Also how did he know on which floor the alarm have started? Officer told him or what?

The alarm he didn't hear he heard when he put his hearing aids in. That's why he put them in, so he could hear it...Is that that heard to understand?
And he couldn't leave, as there was the threat that the alarm was pulled just to get him to exit the building so someone could snipe him off. I guess you missed that part too? It's all entirely logical to him.

Yeah...draw everyones attention to him getting blasted...Again, logical to him

This little bit is from the since withdrawn lawsuit against the Choo's, the owners of the condo where the fire started.

Jonathan's recent CHRT claim includes incidents that were outlined in his suits against the Choo's and Township of Langley. It's amazing how much more detail he included in his human rights claims when compared to his civil suits. I would think a civil claim would require much more of a burden of proof thus require more detail.

The burden of proof in a criminal case is beyond reasonable doubt, in a civil trial it’s the on the balance of probabilities. See the criminal case against OJ Simpson v the estate of Nicole Brown v O J Simpson. Re “rights “ it’s slightly different in each jurisdiction but essentially follows the civil threshold.
Also, the goal of most civil litigation is settlement.

Fair dues, I can see why he was in no rush to get out, after all this is a bloke who was deprived of oxygen for 12 minutes and survived unscathed.

CHRC is not criminal court, neither does it deal with criminal matters.

As for OJ, citing American law when discussing Canadian law is pretty useless. Different nations, different rights, different courts, different rules of court etc..

They have the same burden of proof in criminal versus civil cases, though as you pointed out, CHRC is neither criminal nor civil. It is a quasi-judicial kangaroo court with no real standards where they make it up as they go along. I suppose it's described as an administrative tribunal but it doesn't even adhere to the law to that extent. It should frankly be abolished.

I am a patient person. As I said, re "rights" cases heard in Tribunals and Administrative Courts, these essentially follow the civil threshold, and the OJ reference was to highlight in a particular case that is recent and relevant, (across Western legal jurisdictions that are based in English law,) the difference in outcomes that can be directly attributed to the difference in the burden of proof.

Afaict he just honked his horn and yelled like a fat faggot... how is that an arrestable offense? What is the charge and what did he do? (Sorry I’m on the first few pages and not a maple leaf so this is a little confusing. Bitches do more outside the local pta meetings and we just continue day drinking)

Last video in the OP Yaniv yells "I WILL FUCKING KILL YOU" in the first few seconds which is the uttering a death threat charge.

Did you miss the part where he yelled "I'm going to kill you!"

There is enough similarity since both are based in English Common Law that you don't need some sort of Canadian Permission Slip (tm) to discuss it.

Best if you brush up on the other threads also. This threat was just one of many.

So he "uttered a threat" when he told Chris he was going to kill him. He then called the RCMP (cops) and fed them some bullshit about what Chris had done to him. When the RCMP went to Chris, Chris gave them the video where Yaniv's accusations were proven blatantly false and he threatened Chris's life. So the RCMP, who is currently being sued by Yaniv in 2 separate courts and has had enough of his endless waste of police resources, charged him with uttering threats and 2 counts of mischief, (for filing a false report).

This makes more sense. I couldn’t hear him very well and he has a retard sound to his voice, like he has a speech impediment.

Here you go, courtesy of MeowMix https://meowmix.org/line-by-line-jessica-yaniv-simpson-vs-chris-elston/

Chris: *walks up silently*
JY: *muffled* “you’re gonna get fuckin shot. I will fucking kill you. You gonna send another bomb threat to my phone? I’m watching you. Get away from my car.”
Chris: *silence* *stands on public sidewalk*
JY: “Get away from my car. What do you not understand you fucking asshole. Get away from my car. You wanna call another bomb threat in?”
JY: *picks up phone and expertly dials 911, crank up phone audio in his car*
JY: “There you go. Get away. You wanna get punched, don’t you? Go away. Go away from my car.”
Chris: *literal silence*
JY: *to his phone* “I need police for Langley.”
JY: *turns right, stops at green light. waits for it to turn red. proceeds*

The icing on the cake for me was that Elston didn't utter a word.
