this is probably the first legitimate complaint he has. I don't think he should get any money but whoever leaked his files should be fired, and the guy who bribed them is a cow.

The thing is there is no known leak. The 130 page medical log everyone thinks was "the leak" isn't. That was posted by jon as a court document and made public record.

Yanivs lawsuit alleges that he phoned up FHA and they said "someone accessed your shit but we can't tell you who what when where why or how". He's alleging data was breached, not leaked.

If true, I agree it's a problem, but I'm skeptical that anyone at FHA said that.

Agree. Nobody has leaked his data. That guy who said he bribed someone to give out the records is just bigging himself up. Yaniv is piggy-backing on a data breach that most likely didn’t even affect his own records, hoping to get paid to piss off.

Yeah like an experienced, expensive team of lawyers are going to admit to anything willy-nilly to a hysterical faux tranny.

He made a similar claim re gynecologists where he claimed a complaint was going to be made, wonder how far that went :lit:

I'd just like to observe that in this case, the data breach was in January 2015, the verdict was May 2016, nearly a year and a half later, and the person whose records were breached got less than 3,000 dollars from each defendant.

I can understand wanting to sue based on the morality of something that has been done against you without thinking about the payout. But let's be honest, that's not what Yaniv is doing. So the question is whether it is really a smart (financial) move to keep up a court case for over a year for less than 6,000 dollars in settlements? Subtract costs that the court can't waive for you like gas mileage and it's even less.

Then again, he did celebrate the pittance he was given for the physio bed settlement. Color me baffled.

I don't want to speculate on Yaniv's finances too deeply, but if this is the kind of financial genius he displays, I can't imagine they're good.

Yaniv vs. Fraser Health/PHSA
Fraser Health and Provincial Health Services Authority have filed a response to Yaniv’s lolsuit.

The defendants admit that Yaniv’s data was accessed by an unauthorized person from each FHA and PHSA, and that these employees were disciplined internally. There is no evidence that the records they viewed were disseminated.

Yaniv was given the option to place “VIP” status on his health records, effectively locking them, and Yaniv requested this.

FHA/PHSA say that Yaniv’s claim is not clearly pleaded, which we knew weeks ago, but they made an interpretation of the claim that appears to align with Yaniv’s goal, and they deny his claim entirely.

The defendants state that (as predicted) the case must be dismissed because the BC Small Claims court doesn’t have authority to hear an action related to the Privacy Act.

Yaniv’s other claims about FHA/PHSA having a duty of care should be dismissed based on previous case law. Likewise, case law suggests there is no common law cause of action for breach of privacy in BC.

The entire reply is a thorough and damning response to Yaniv’s vengeful and profit-driven lawsuit and should put a quick stop to it.

I reckon it'll be the one court case that nobody gives a second look that will eventually $$$ cripple him.

Fraser Health has the resources to tell him to put up or shut up, and I really hope they do. They will have in-house lawyers to handle this. I myself wouldn’t offer him a single cent.
In the great scheme of things yaniv, to them, is just an annoyance so I'm expecting him to get some feck off money which he will claim as a massive victory/amount.

I would dearly love Amy Hamm to be the one who nails this fat bastard and do what the large organisations have, as yet, failed to do.

Especially given that the telehealth information is a matter of public record due to actions that he himself undertook.

Refreshing to see some actual attorneys getting involved here. These guys are probably on salary which can make a big difference believe me. A guy working flat rate is likely to lose his enthusiasm shortly after the check is deposited, whereas an hourly biller (such as myself lol) is all too likely to start "stirring the file."

I think we've finally found a good match for CaptainPedo.

In Canada, we have a process (at least in Theory) that is supposed to stop people who establish a pattern of filing Bullshit Lawsuits.


Hopefully, Yaniv will eventually be labelled a Vexatious Litigant.

Edit: Also, unlike the US, if you file a bullshit lawsuit, you can be ordered to pay the defendents legal expenses-- or even damages to them in some cases.

He must be mad because he tried to file some new private prosecutions today and instead of being accepted to be processed (and then rejected) they were immediately placed on hold pending a review by a Judge.

Another $35K he won't see.
