Some non-LEO can encourage you to break the law all day. If you break the law you don't get to plead innocent on the basis that they suggested you do it.

I don't know how Canada does these things, but it's still illegal to hit on an under 18 you know is under 18. And it's not like he has to be entrapped. He's openly engaged in pedophile behavior.

It's also a crime knowingly to provide pornographic materials to children. I assume it is in Canada, too, although I don't know for sure.

If she actually wasn't over 18, though, it probably doesn't matter. Solicitation is a crime, and so is attempted solicitation, but without someone better than an Internet troll as the witness it's probably not going anywhere.

Age of Consent in Canada is 16 for any sexual activity. This does not apply to transmission of explicit photos. While he could likely get by on sending nudes to someone if they represent themselves as 16+, he would still be in trouble for requesting nude images from such a person.

For those interested, it would be a grey area if such images were sent by a person under 16 to an older person without that other person requesting them. If it occurred once, the images weren't stored anywhere, and the older person requested no further images, they would probably be okay in a court of law. Failing to do that and allowing it to continue, or failing to end the relationship after a second occurrence like I already described, off to the pokey.

Canadian law seems dystopian to be honest. On the one hand, you've got cops doing Mr. Big stings, on the other you've got insane cases like this where blatant pedos get off on the grounds that they thought the person they picked up from school was an adult.

The case mentioned did not determine that the defendant was not guilty, it just decided that the presumption under which he was being tried was unconstitutional and sent the case back to a lower court to try again. So not quite as bad as it seems.

Rather than the defendant having to prove why he thought he was talking to an adult (presumption of guilt) the government has to prove its case that a reasonable person would think they were talking to a child. Which I bet they could given, as you said, that he went to the school, etc.

And that was a state actor taking on the role of catfish. But it's not like this is going to somehow get Jonathan in trouble, based on what we've seen. Until, that is, he tries it with an actual girl and her parents find out.
