If he's right-handed, then he would likely be holding his phone in his left hand and gesturing with his right, which would mean he's in the driver's seat. If he's left-handed, then it would be vice-versa and it would mean the image is flipped.

it has nothing to do with the hand placement and everything to do with the direction of the seat belt over his shoulder. Upper left to lower right is always the driver's side. And before someone suggests the backseat, too much direct sun from the front.
