It might be illegal, isn't VA a 2 party consent state?
It can "mysteriously" appear on /cow/ like Ralph always does when he wants to leak something and not get in trouble.

Ralph can still claim he was hacked and that he only accepted the plea because it was the easiest thing to do. With a recording of him admitting to putting it out there maliciously he can't hold on to the "it's complicated/I'm innocent/Faith is a psycho and jealous that I'm with May".

Besides, Ralph got away with putting out revenge porn of Faith and admitting it on tape, what could be the worst outcome? A fine?

I never said they are smart, I think their openly fucking with Ralph has been retarded. Shutting up, disappearing whilst keeping their powder dry in regards to what they have recorded of him would have been the best move.

It is possible they have different motives which are simultaneously stupid, and smart.

If they have some "secret" recording of Ralph screaming at Faith how she deserved to get humiliated with the release of the tape, why not release that audio at this point? I understand they were saving it for trial, but what the fuck does it matter now? Just release it @MWV, you wanted to upset Ralph, that audio being released is more likely to upset him than the suspended sentence he's been celebrating.

"The California Supreme Court ruled in 2006 that if a caller in a one-party state records a conversation with someone in California, that one-party state caller is subject to the stricter of the laws and must have consent from all callers (cf. Kearney v. Salomon Smith Barney Inc., 39 Cal. 4th 95[52]). However, non-disclosure recordings by one of the parties can legally be made if the other party is threatening kidnapping, extortion, bribery, human trafficking, or other felony violence. Also included in the exception is misdemeanor obscenity and threats of injury to persons or property via an electronic communication device (usually a telephone) if directed in whole or in part towards a conversation participant or family members."

In which case it does make sense why they would not initially allow Faith to submit the phone call recording as evidence in of itself because they would have been party to the California laws. Ralph cannot of directly threatened to do anything which falls within the above exemptions.

I do not understand why 2 party consent laws exist, and if they must why not provide a general exemption for the prevention or detection of crime.

@Jack Awful Faith already gave a description of it months back, it's allegedly Ralph admitting to releasing the tape, saying some other DV related stuff and then screaming I'm a king down the phone.

The Vickers are giving the TRO violation trial too much faith. It's part of a crime prior to the revenge porn and won't cause him to violate his suspended sentence.


Now I don't know the laws but Ralph has plenty evidence showing the Vickers harassing and goading Ralph on various websites. That might possibly make the judge view the Vickers in a less favorable light. I really don't understand the Vickers nigger behavior about this. If I had gotten a restraining order on someone I'd basically only tell people I'm around daily that need to know just for safety reasons. I wouldn't go on Twitter and shit talk the person in public or poke at them. Especially if the person is a vindictive wigger like Ralph. If the Vickers were smart they'd do the same and just handle shit through the courts and lawyers, but they're dumb wiggers like Ralph. I was initially sympathetic to the Vickers as having revenge porn released of your daughter and the fact she was knocked up just to earn internet W's is pretty fucked. The real reason Matt decided to go with the deal where Ralph more or less gets away with no punishment instead of testifying is he was probably scared it wouldn't hold up and Ralph would go innocent.

I doubt it's the appeal reason because if Vickers knew he could get Ralph behind bars he would sacrifice almost anything to make it happen.

Ralph is going to plea no contest either way. No matter what happens, Ralph is going to be found guilty. In no way shape or form was Ralph ever going to get any serious jail time over this. I will lay money that the DA and Ralph's attorney were both telling their clients that this was the exact outcome that would happen if they go to trial with it.

The ultimate conclusion either way was going to be Ralph pleading NC, guilty verdict, no jail time. Either offer it to him as a deal before hand, or go to trial and get the exact same result.

Vickers lost either way because the win/loss condition was jail time. No matter how either side spins it, Vickers took the option that was the path of least resistance.

From what that article states, only those crimes that have specific exemptions would allow for Faith to release the recording without Ralph's consent.

Presumably no, because the laws in California would apply to Faith whilst recording the call.
