There's been an update in the Chris Hook / Allstate court case.


Allstate had asked for $41,748 in costs and attorneys' fees. The judge awarded them $17,808.
Remember this when you see other sanction awards. This is the sanction award in a case where the judge was literally enraged with the lawyer to the point of yelling at him and berating him in court. He might have even let him off easy because he was so obviously pissed a huge award would be seen as biased by the judge's personal animus.

So I looking at the court's reasoning, because I find it interesting...

20.2 hours were excluded because Klee's initial representation to the court was that the firm had billed 13 hours to bring the application, but they later tried to claim that they had billed 20.2 additional hours for that (making the new total 33.2 hours).

3.7 hours were excluded because their description merely stated "PRIVILEGED" and the court ruled that it could not determine if they were reasonable.

4.7 hours were excluded because the court ruled that they didn't necessarily pertain to the application and they were incurred unnecessarily.

10% of their block billed time was excluded and 10% of the duplicative hours were excluded because they were block billed and/or duplicative.

Finally, a 10% "haircut" reduction on the claimed hours was imposed just because the court felt like it; this amounts to the largest "haircut" reduction a court is permitted to impose "based on an exercise of discretion and without a more specific explanation." So, it appears that after the court had already cut their fees on everything it found reasons to cut them for, it then docked them by an additional 10%, just because it could.

In the end, this amounted to overall reductions of 51%, 47%, and 63% respectively for Klee, Feldman, and Burns.

As for their rates, the court ruled that they "failed to establish a satisfactory market rate for its rates," that they had billed some of their hours for "tasks which do not require great litigation skill," and that they "failed to justify" why Klee and Feldman deserved to bill at higher hourly rates than Burns ($490 vs. $420). It cut them all down to the same rate, making the final bill 42.4 hours at $420/hour.

What do you mean unremarkable? You can look at the videos he has in his playlists and easily peg his age range somewhere around early to late 30s. Zoomers don't listen to fucking Three Days Grace. I was born in '94, which puts me literally at the youngest of the Millenials, or the very oldest of the Zoomers. Three Days Grace was already popular when I was heading into middleschool, and were phased out almost entirely by Highschool.

Indie Rock was getting way more popular than Nu Metal, or just- Indie in general, and it was leading to the rise of a lot of edgier Pop music c.2012 that included more synths and falsettos. Seeing as how there's none of that, neither the Indie or Pop; this will put his approx 'peak music' age somewhere around the mid 00's.

It also doesn't help that he has Comedy Central playlists, and no one under 30 watches Comedy Central anymore, because YouTube/Vine/Twitter/Insta/Internet sketch comedy exists.
