Also there's at least one strain of OPCAL who are at least to some degree responsible for why cops get so trigger happy. You know, the ones that drive and think it's a kino idea to shoot cops for "DeTaInInG tHeM", making said living cops more likely to just fucking shoot first and ask questions later.

Asking if you are detained is a good thing to do in case you need it for court wrangling later (after cop has had you sitting there for a reasonable amount of time), but shrieking like a banshee about it from the get go or the instant the cop asks you a question you dont like because you cant answer it (like, say, "Got any drugs or weapons in the car/on you?") is pure exceptionality. The cop will respond appropriately to your strange verbal hostility and general sped behavior by going even further up your ass, and 99999 times / 100000 prosecutors and judges will back them up. Discretion is the better part of valor when cop is sniffing around and you've got a half pound of whatever in your trunk because you didnt sign no true and honest contract agreeing drugs are bad mmmkay

I don't get the "am I being detained" thing. If they're told no, they still stand there acting weird. If they're told yes, they still stand there acting weird. They don't challenge the cops on it or anything either, they're just like "ok, I'm detained." All their buddies think this is "total education ownage" of the law though.
This is because of their weird thought pattern where if they say the right magic words, magic things should happen. The fact of whether you're detained or not does not hinge on whether certain magic words are uttered. It is quite simply whether or not you can leave without being hindered. "May I leave?" If the answer is yes and you can walk away or drive away or whatever, you are not detained. If the answer is no, if you will be restrained or smacked around or tazed, you are, indeed, being detained.
Reminds me of Metokur's video where one of them talks about "word magic" and how because the word navel sounds like naval that means the government invented it to say all American babies are naval property and thus can be legally kept under martial law, or something. They really do think that words have some kind of magic power, like "You're dismissed" will make cops disappear.
I think they got some of this from the Miranda ruling and the subsequent 'magic invocation' of Mirandizing suspects. Frankly, the Miranda case has taken on far more weight than it should; that being said, when you consider that prosecutors and cops are under no obligation to tell you the truth either, one can see why a requirement to explain the rights held by a suspect is held inviolate.
I think it also has a lot to do with bogus traffic stops/drug searches that crop up in some big metropolitan areas. There used to be a trend (so famous it was immortalized in a song) of cops holding people quasi-legally for no reason just to waste enough time that they could bring a drug dog to sniff the car.
