The producers at Michael Bay's company Platinum Dunes have been associated with the FRIDAY THE 13TH franchise for over a decade at this point, and unfortunately they've only actually managed to produce one new film in the series during that time, the 2009 reboot. That isn't for lack of trying, though. Since the release of F13 '09, Platinum Dunes has been involved with the development of at least four more scripts - the first being a sequel to the '09 movie, and the other three being different variations on a reboot.

Legal issues have now put an end to any further development of FRIDAY THE 13TH movies for the foreseeable future, as original FRIDAY THE 13TH director Sean S. Cunningham and screenwriter Victor Miller are taking each other to court over which of them truly deserves to hold the rights.

While we wait to see how that battle will pan out, Platinum Dunes producers Andrew Form and Brad Fuller are hoping they'll get a chance to make another FRIDAY THE 13TH movie someday.

Speaking with the folks at WeGotThisCovered, Form said,

There’s a lawsuit going on and the rights are a little messed up. But rest assured, we are doing everything we can to be involved with that and we wholeheartedly believe that another version, another incarnation of Friday the 13th, needs to be made and brought out to the world, and we’re gonna do everything we can to do it. Every year, we look at the schedule and say, ‘When’s the next Friday the 13th? When can we have a movie ready?’ We love Jason and we hope we can make another one.”

In fact, of all the classic franchises Platinum Dunes has been involved with (THE TEXAS CHAINSAW MASSACRE, A NIGHTMARE ON ELM STREET, THE AMITYVILLE HORROR, etc.), FRIDAY THE 13TH is the one they're most interested in returning to.

Friday the 13th is the one for us, because we were so close to filming that version about a year and a half ago, and we loved the screenplay we had and we were so close on that one. I think that’s the one out of everything we’ve done in the past, except for [Teenage Mutant Ninja] Turtles… We hope to bring another Turtles movie out. But I think Jason is the one right now for us that we’d love to get our hands on.”

It's disconcerting that they loved the script that almost got filmed last year, because it was pretty awful, but I'd be down for another F13 along the lines of the 2009 film. At this point, I just want reassurance that we'll even get another FRIDAY THE 13TH movie someday, whether Cunningham remains in control of the rights or Miller takes it over.

I don't know why they're not milking Amityville for all it's worth. You've got double the name recognition here with the Warrens being involved and the franchise itself. Not to mention that the current horror landscape seems to favor "Satanic" villains and nondescript "demons." Paranormal Activity, the Conjuring, and Hereditary all come to mind as examples.

I don't know why they're not milking Amityville for all it's worth. You've got double the name recognition here with the Warrens being involved and the franchise itself. Not to mention that the current horror landscape seems to favor "Satanic" villains and nondescript "demons." Paranormal Activity, the Conjuring, and Hereditary all come to mind as examples.
There was an Amityville movie last year. It was supposed to come out in 2015, then was put out for free on Google Play.

Never understood why New Line got Platinum Dunes to remake Friday the 13th and A Nightmare on Elm Street, seems like such a pointless business move when they would have done the same box office wise if they did it internally.

He has fought Ash with Freddy in a comic. They even wanted to make a movie out of it but it never got off the ground. I pretty sure the did Jason vs Michael in the comics as well, and Leatherface and his family tried to adopt Jason at one point. Than they fought.

I don't think VS movies are really the in thing right now. And that's sad.

But a shared universe ala Marvel is, and the real problem is that they didn't have any control of the characters they always say it was the ending, not wanting Ash to kill them both, which I think is bullshit if that was the problem why not re-write the script and change it so that the teens are the ones that kill both Freddy and Jason, and that Ash was helping them?

I want a comedy scene where a cop takes his machete (loisense joke goes here) and then he goes around killing people with the cop, like that time in Jason X when he killed the one girl by beating her to death with the other girl.

For over two years, fans of the FRIDAY THE 13TH franchise have been waiting to hear the outcome of the legal battle being fought between the original film's screenwriter Victor Miller and producer Sean S. Cunningham over the U.S. rights to the series. If Miller could prove that everything in the script was created by him, as he claimed, then U.S. copyright law would allow him to take ownership of the film now that more than 35 years have passed since its release. But if Cunningham could prove that Miller had only written what he was hired and told to write, as he claimed, then the F13 rights would remain in his hands.

While the court has been trying to figure this case out, development of any further FRIDAY THE 13TH films has been put on hold and recently released F13 games even had to stop updating their contact. FRIDAY THE 13TH has been in limbo.

Now a ruling has been made, and things have gotten a bit more complicated for the F13 franchise.

The court has ruled in the favor of Victor Miller, granting him the copyright of the original FRIDAY THE 13TH in the United States. If this ruling goes through as is, the only thing in that first film that Miller won't hold the copyright to is the scene involving a motorcycle cop, since that was an addition to the script made by another screenwriter.

This means that Miller would be fully within his rights to pursue making a sequel to FRIDAY THE 13TH - but the issue with that is, he only has the rights to follow up on what was in that original film, and anything he makes could only be distributed within the United States, since he would only hold the copyright in the U.S. And where would that leave the character of Jason Voorhees, who was only presented as a drowning child in flashbacks (and then pops out of the water to grab the heroine at the end) within the original FRIDAY THE 13TH? The court declined to rule on whether or not Miller would be allowed to use the adult slasher version of Jason that appeared in the sequels:

I also decline to analyze the extent to which Miller can claim copyright in the monstrous 'Jason' figure present in sequels to the original film. Horror Inc. may very well be able to argue that the Jason character present in later films is distinct from the Jason character briefly present in the first film, and Horror or other participants may be able to stake a claim to have added sufficient independently copyrightable material to Jason in the sequels to hold independent copyright in the adult Jason character. That question is not properly before the court in this case, however."

What this really means is that Miller and Cunningham are going to have to continue working out their legal issues with each other, whether that involves Cunningham appealing this ruling or the two getting together to make a deal. It's not likely any studio is going to want to work with Miller to make a potentially Jason-less FRIDAY THE 13TH movie that can only be released in the United States. To definitely get an adult, murderous Jason in the picture and to ensure worldwide distribution, Miller would have to make an agreement with Cunningham. To avoid dealing with Miller, Cunningham will have to hope that another judge will rule in his favor in another round of this copyright dispute.

This issue isn't settled yet. FRIDAY THE 13TH might stilll remain in limbo even after this initial ruling.

This past Friday, news broke that Friday the 13th screenwriter Victor Miller has prevailed in a lengthy legal battle that will determine the future fate of the franchise.



It was explained that U.S. District Court Judge Stefan Underhill granted summary judgment in favor of Miller and against the producers, Horror, Inc. Full details were not disclosed, but Miller is said to be retaining the Friday the 13th rights in the U.S. alone, which makes it complicated to use the title.

As for Jason Voorhees, his infamous mask wasn’t introduced until Friday the 13th Part III, which means Horror Inc. can use the character without Miller’s consent.

In fact, Bloody Disgusting just obtained a statement regarding the recent Friday the 13th court ruling from franchise producer Horror, Inc.:

“We are disappointed in the court’s ruling and disagree with its conclusion. We are considering our options including an appeal. In the meantime, the court was very clear that its ruling in favor of Mr. Miller is limited to the original screenplay in which Jason’s mother is the killer and that Mr. Miller’s termination notice did not purport to terminate the separate copyright in the iconic supernatural killer who wears a hockey mask. It also does not grant any rights to Mr. Miller that would enable him to use any element of the original screenplay outside of the United States.

“Following the guidelines set down by the Court’s ruling, we intend to aggressively explore many opportunities for new projects featuring settings and characters (including the hockey mask-wearing killer) not included in Mr. Miller’s screenplay, and in fact are currently in development on new projects that are consistent with the ruling which will be announced soon.”

This is all vague and extremely unclear to me. One thing we know is that Horror, Inc. will have all international rights. It’s very hard to understand the full ramifications of the ruling, but what we gather is that Horror, Inc. plans to bring Jason Voorhees and characters from the later Friday the 13th films to life in new projects either way.

The good news here is that Jason Voorhees will find a way to be resurrected, but it sounds like this is going to be a long road to resolution. We’ll keep you posted as new details surface, and with any news on Horror Inc.’s forthcoming Friday-related projects. Watch this spot.
