The second lawsuit related to ComicsGate has arrived!
Preston Poulter and John T. Lamont are suing Ethan van Sciver, Victoria C. Kundert, and Ali "Dean" Assaf for Defamation, Slander Per Se, and Cyber Libel in the United States District Court for the Northern District of Texas. The presiding judge is James E. Kinkeade.
On a side note, this lawsuit is the first time a Kiwi Farms user is actually suing not one but two other Kiwi Farms users.

Preston Poulter (@PocketJacks) - Poulter is a known detractor of Ethan van Sciver and the ComicsGate movement who hosts a YouTube series known as "Last Week in ComicsGate" (archive). Poulter is a comic book writer himself and once tried to trademark the "ComicsGate" branding to use for his own purposes, but was rejected. However, users on Kiwi Farms may know him as the guy who got pegged in cuck porn (the only time anything from the ComicsGate thread made it to the front page of this site).

John T. Lamont - I will refer to @Smug Freiza's post because it not only gives info about who Lamont is but also what lies at the heart of this case:

A giant scandal was just revealed on DA Talks and @VIkkiVerse's latest CGDG stream, in that a creator of Preston Poulter's Comicsgate™ and several others were sharing lolicon (cp) in Preston's discord server. The individual in question is one John Lamont, who was previously an entrant in Preston's Comic Contest which took place last year, a contributor to Preston's now defunct Comicsgate™ shared universe and a regular guest on Preston's writer's streams. According to the video previously put out by DA Talks, John Lamont and Preston are old friends from Preston's time living in Los Angeles.

I decided to investigate this further myself to see if there was any truth to the claims and was shocked at the degeneracy that continues to abound within Preston's Comicsgate™ faction. When searching for the term "loli" in Preston's server, I was surprised to discover 40 results, which is obviously 40 too many.

The majority of the results appear to stem of this John T Lamont, Larry M Holder and another individual called "Can" sharing lolicon pictures and debating the morality of lolicon between themselves in a channel described as a "MGTOW-redpill-blackpill" channel. Again I must stress that the images have been censored so not to break site rules and will be spoilered below.

Oddly enough the response has been rather conciliatory towards the sharing of lolicon, with Otis Stein creator and Kiwifarms member @Skinny describing it as a "gay op". I'm sure Skinny can give us a detailed description about how DA Talks hacked John Lamont's account and shared lolicon in Preston's server?

In Lunga's defense however, he appears to be one of the sole voices telling Preston that the sharing of lolicon in his server is a bad idea, so I guess I have to give credit where credit is due.

The Defendants
Ethan van Sciver (@FROG) - Noted comic book artist that has worked on numerous titles for Marvel & DC, especially Green Lantern & The Flash. He is the de facto head of the ComicsGate movement and currently publishes comics under the ALL CAPS brand, such as his own CyberFrog, Kyle Ritter's StarBlades, and, very soon, Richard C. Meyer's Jawbreakers. He also has his own YouTube channel.

Victoria C. Kundert (@VIkkiVerse) - Better known as VikkiVerse on most platforms, she hosts her own YouTube channel as well as being Dean Assaf's co-host. It should be noted that she has been critical of @FROG in the past, but here she is as a co-defendant with @FROG and being sued by @PocketJacks.

Ali "Dean" Assaf - I will copy and paste a brief overview I gave recently of Assaf:
DA Talks aka Dean Assaf, the brother of Andrew Assaf (Crow of Judgment).
He and his brother were very active at the beginning of Weeb Wars, but grew disillusioned by certain figureheads (mainly ThatUmbrellaGuy, YellowFlash, and Hero Hei). Unfortunately, the brothers had a falling out over @kittenpoptart (GothicSushi) when Crow became one of her simps.
He started releasing expose videos on @MarzGurl, ThatUmbrellaGuy, @kittenpoptart, John Michael Kelly, and got into a slapfight with @Tyne (Liam Gray) that got a spot on one of Nick Rekieta's streams.
Now, Dean co-hosts streams with @VIkkiVerse over ComicsGate (even had @FROG as a guest) and other topics.

The Case

@PocketJacks and Lamont are claiming comments made by Assaf, @VIkkiVerse, and @FROG on various streams on Assaf's YouTube channel regarding Lamont's choice of artstyle as pedophilic (and by extention calling Lamont a pedophile) and @PocketJacks endorsing such content are defamatory, slander per se, and cyber libel. The Plaintiffs' argue that these "statements were designed to reach third-parties, and to target the Plaintiffs in their homes and cause damage and financial harm to them in their homes and beyond."

As such, they want to be compensated for the "shame, embarrassment, humiliation, and mental pain and anguish" caused by the Defendants. Furthermore, they argue they will "be seriously injured in their reputation, good name, standing in the community, and will be exposed to the hatred, contempt, and ridicule of the public in general as well in their business pursuit." One of them (most likely Lamont) has argued they already suffered from "(1) loss of revenue for downloads and subscriptions to the comic; (2) loss of future sales; and non-economic damages in the form of mental anguish" as a direct cause from the Defendants' statements.

It should also be noted that @PocketJacks did send a Cease & Desist letter to Assaf prior to filing this lawsuit, which Assaf did an unboxing video of:

Only time I've ever seen Preston is when he self-posts his videos raging about ComicsGate to https://www.reddit.com/r/WerthamInAction/ -- ostensibly a "ComicsGate" subreddit that was created back around the start of GamerGate and abandoned. (I.e., before ComicsGate.)

To this end, his reputation was already shit, and I don't think @FROG et all could have done anything to harm it.

He has a person of interest tag. There's a lot of people in CG that could probably do with separate threads but, for one reason or another, haven't gotten them yet. Yeah, but in this case, the accusations are fairly well grounded. Especially against Lamont. The OP links to a post where his particular taste in artwork in very well documented (and gross AF).

The more I think about it, the more I don't think this was a case drafted to see the inside of a courtroom, let alone succeed.

Think about it, the complaint is poorly drafted. There's typos galore. It doesn't look like it was proofread at all. The claims being made about statements said have nothing to validate it: there's no exhibits attached, there's no screenshots of archived tweets, there's no links to videos or time stamps. Everything mentioned is "it was said on a public platform" with no mention of which platform it was on (Facebook, Twitter, YouTube, etc.) Overall the entire thing looks like it's for one purpose: to insulate Preston from criticism for doxing Dean and Vikki. If he had come out and dropped their information, he'd have been rightly criticized for doing it by his own supporters. Instead, he files a complaint that has very little hope of winning at all, and there's the constant use of "Defendant Dean Assaf, a/k/ DA Talks" and the same with Vikki, where lawyers would have routinely put something like "Defendant Dean Assaf (heretofore referred to as "DA Talks")" the first time to save time and paper. No, this entire thing looks like it's an attempt to just dox them as a bullying tactic, especially since he believes they can't afford the lawsuit whereas he claims he can.

Also, they have to prove $75,000 for each defendant, not combine it to reach that number. That means Preston and John have to show a total of $225,000.

The damages bit looked super sketchy to me, not surprised the judge is questioning it. They cite a $500,000 demand amount in the cover letter, yet then do absolutely nothing to justify it in the complaint. Heck, they don't even cite $500k anywhere in the complaint. I'd be amazed if their comics had anywhere near that amount in sales, let alone a demonstrable drop in sales of that degree.

Edit: I hope this ends up like that dumbass tattoo artist case though, where the end result is an official record documenting the plaintiff's misconduct and a Streisand effect that amplifies it.
