Agreed. Predicting anything legally, especially in courts in Texas, is a very dangerous game. Nothing is ever really a slam dunk legally. And they can certainly go back multiple times to rework the complaint to make it more specific and stronger. The document in its current form could be a sort of placeholder where the attorneys come back and firm it up when they decide to spend the time doing it.

What worries me is; is the Judge another Chu(m)pp and if the original drafts have been by someone else are the actual attorneys involved going to be more competent as this goes on.

Either one of these things costs Vikki/Dean/Ethan more money to deal with.

It would depend on the court in question.

Could they be looking to let the clock run out and refile?

This is my guess at a timeline based on other past stuff in the Federal 5th Circuit. And this is just a guess. I'm no expert.

The next event should be for Poulter to request a summons on the defendants.
Then around roughly a week later, the defendants will have been served and summons comes back executed to the court
The defendants might be given about three weeks from the time they were served to respond.
If they filed a motion for a two or three week extension for the initial response, it would usually be granted without opposition.

So we are possibly about eight weeks out from the responses being made to the complaint. But there
could be slowdowns to the process due to COVID.

I'm somewhat surprised that the summons have not been requested from the court yet. I'm not sure what the deadline
would be for that. Its usually sort of an automatic thing at the start and I don't know why anyone would delay doing it.

It's an invalid summons to begin with. His name isn't Dean Assaf, which they fixed in their amended complaint, so I believe a new one will have to go out for him. To my knowledge, Vikki hasn't been served at all. In fact I don't believe anyone has been served at all, let alone properly. Since there's no proof of service on the docket at the moment then that supports my assertion on the matter. They're also looking to bring Randall Hegg, a/k/a @TESTEFY-HD into the lawsuit. His address and dox were apparently posted to Preston's Discord.

DA Talks put up a whole lot more information in a video which will helpfully tie the name in the dox to "testefy" for Preston. All these people are more concerned with their dumb youtube feuds and personal drama than legally defending themselves.

He's not a codefendant, and he's probably the one that--if he's dragged in--no one will want to deal with at all. Ethan is not a fan of Testefy because the little cancer loves to fucking cause shit and spread rumors for attention. He was literally trying to drive a wedge between Dean and Vikki, even saying multiple times he had "evidence" that everything Preston accused them of was true--only to then turn around when told to produce said evidence and admit he had nothing more than "they joined my server". He was also saying he hopes Preston takes Vikki--and later Dean--for every penny they have. Honest opinion, with Testefy literally calling Preston and John Lamont pedophiles and child predators they have a much stronger case against him than the others.

The case wasn't dismissed because of improper service, the default judgment that was entered for Melinda was vacated because of the improper service. That being said, I do not see this case proceeding beyond the motion to dismiss for either failure to state a claim, or lack of jurisdiction on the part of the court.
