Another theory is that they were clear about the costs, but started pressing for a big retainer after the complaint was finished. Not saying it happened in this case, but one way for a firm to get out of a case they don't like or don't believe in is to suddenly demand lots of cash up-front for future services. A retainer can also be used to flush out a client's true intentions. There are lots of people willing to pay for a case $1000 at a time who suddenly look at things differently (or don't have the money) when asked for a down payment on the whole case.

This case isn't going anywhere and he has to know this. The entire point was to dox Vikki and Dean specifically via legal channels, so he could sidestep claims in the future about being a doxer. "I didn't dox them, it was in legal paperwork." It's vexatious in and of itself, and this case will either be transferred to two more venues (I highly doubt this case is remaining in Texas, since neither Vikki nor Dean have any attachment to Texas, though @AnOminous can correct me if the fact the three defendants are in separate states would somehow bypass this for the plaintiff's financial benefit) or be dismissed outright by a 12(b)(6), assuming he doesn't dismiss it himself.

That being said, Preston claims several times in his lawsuit that he either owns or "hosts" Comicsgate, but his GoFundMe states that he wants to "stop Comicsgate". So if he owns it, why does he want to "stop" it?

If he doesn't serve the defendants that will happen automatically. I think Texas's long-arm statute is broad enough it might apply, but from cases in Texas I've seen (including Meyer's case against Waid), courts in Texas aren't very fond of exercising jurisdiction over things that just happened on the Internet. They want some kind of physical or business presence, or at the very least, something specifically directed at Texas, which could be as little as a phone call to a Texas business, as Waid found out.

It can't just be nothing, though.

- The host opens by saying that he wants to focus more on "victim stories" from comicsgate like Preston's story. He seems to have been presented a simplistic story where Preston was attacked out of nowhere with an unsupported Pedo accusation because he was fighting comicsgate.

- Preston's narrative is that Comicsgate was founded in 2016/2017 by political idealists. But that after Ethan arrived, it was hijacked by "free speech absolutists" who want to be able to say anything without consequences. Ethan took over the name "comicsgate" from unnamed parties and made it his own. He said that Ethan was a pragmatic drama farmer rather than being political.

- At around 11:10, Preston makes an extremely damaging statement as far as the trademark situation goes. He says "Ethan acted like he was conducting it (comicsgate) as his business." "He was comicsgate and comicsgate was him." He seems stupidly unaware that FROG's claim to the trademark is around some of those very points he just agreed with.

- He claims that comicsgate has said that people have to engage in cancel culture to fight cancel culture.

- Preston's new story is that he trademarked comicsgate to force people to define what it was better and to force people to take individual responsibility for the things collectively done under a hashtag like comicsgate. That comicsgate is a sort of mask that people were hiding behind to do bad things and that Preston owning the trademark would eliminate that.

- Preston claimed he had to act because of the failure of the justice system to deal with comicsgate.

- The host says he is a former EVS fan but has seen him as devolving since 2011.

- Preston went to some gaming show in North Texas recently and he talked to vendor next to him. The vendor talked about how gaming people and RPG people are more mature than comic book people (yeah....right). He discussed comicsgate with the vendor who said comicsgate was toxic and mean. Preston says comicsgate is a "weird cult".

- They claim that people in comicsgate are not allowed to read certain comics like spider-man. That they will be kicked out of comicsgate for reading the wrong comics.

- The host claims that Ethan tried to silence him at some point in the past.

- The video ends with Preston shilling his books. The gofundme is also mentioned in the video.

Lamont and his art is never shown or otherwise addressed in the video. From the video's point of view, the entire case is about Preston being called a Pedo with no basis to the accusation at all. The only art shown in the program is photos of the covers of White Lily and Prerston's other book.

Not that his legal conclusions matter to the court, but that's literally the definition of "used in commerce," and that the term "Comicsgate" immediately suggests Ethan van Sciver to a person in the target group for buying "Comicsgate" products. That said, if any one person can claim to "own" the term, it's EVS.

In the video Preston also explained that Lamont's work cannot be pedo because it was on Deviant Art. He claimed that since the ToS on Deviant Art disallows pedo, nothing appearing on the site can be pedo. He also claimed that "loli" is undefinable and therefore Lamont's art cannot be Loli. Preston also claimed to not be any sort of expert or to know what was acceptable "loli" and unacceptable "loli" in terms of his own discord. Then, weeks before it became widely known that "Slick Jimmy" was in jail, he announced on the video that he loved Slick Jimmy's comic "Little GIrl Lethal".
