Even on the latest firmware, you can hack your 3DS and get custom firmware, and then you can pretty much do anything with it.

You can just use Soundhax if you don't want to risk bricking your 3DS because you're too cheap to buy a new one. I'm pretty much in that boat and that works just fine for playing Game Boy games on my "old" 3DS, I play Wario Land and Pokemon Prism on Gameyob that way.
Also I have quite a bit of Pokemon that I put some good time into catching and raising, so I would personally just get a cheap used 2DS to use as a full fledged homebrew device so if I fuck up then there's none of my data lost.

It's not the end of the world if the answer is no since I got a new 3ds for christmas so I can keep that one ~~pure~~ and use my old worn Pikachu Old 3DS to do the homebrew firmware-y stuff. I already used my copy of OOT3D and my powersave cable to get the homebrew launcher installed on it so that's like 25% of the work done right there, I'll add soundhax later today to make it more convenient. If I can still do online stuff with the homebrew then I might get Soundhax on my N3DS and try to repair my Pikachu one enough to trade it in since I still have the box.

And Mario Kart 7 is a pretty good game, even better for the fact that it's bundled with some 2DSes.And if you get the $80 Mario Kart 7 2DS, that's a pretty cheap fuckin' portable emulator box you've got there with some alright controls.
