They executed a search warrant to see if they could uncover evidence of CP possession/distribution. A search warrant is not an indictment, which is a formal charge of criminal conduct. Search warrants get served all the time with nothing happening to the target of the warrant. They either couldn't break the encryption, or they did get to look at the material, and determined it wasn't child porn. I think the former is more likely than the later. Courts have ruled that pictures of minors don't have to include nudity to constitute child porn. They just have to be presenting in a sexual manner. Apparently, nothing came of the warrant, because if it had, someone would have dug it up when the story first broke. Also, he'd most likely be on the sex offender registry and he's not. He's just on the hook for the tax man.

Not even that, there's cheaper colocation hosts out there. One that comes to mind is Dacentec. It's outside of Charlotte, NC, and sells full rack space at $500 a month. It's really not that hard to find cheap colocation.

Hell, ColoCrossing (where 1776 Hosting is) has relatively cheap colocation as well. Not sure of the price, but still relatively affordable.
