Court records show that U.S. Customs and Border Protection officers saw that the ignition had been punched out and suspected the truck was stolen, but allowed Sitts to proceed when they could find no report of the vehicle having been reported stolen.
However, once Sitts reached Mexican soil, customs officials there confiscated the truck after he was unable to produce a license and registration.
Later that day, CBP learned that the truck had, in fact, been reported stolen in the United States, but an officer had entered incorrect data while conducting the earlier computer search.
Meanwhile, Sitts tried to cross back into the United States on foot and was arrested. According to his pre-sentence report, he later told a probation officer that he didn’t know for sure that the Toyota was stolen when he tried to drive it into Mexico, but said he was high on methamphetamine and heroin at the time, which hindered his decision-making abilities.
Sitts, 36, was sentenced Dec. 5 by Judge Thomas Fink of Santa Cruz County Superior Court to four years of probation after he pleaded guilty to a Class 3 felony car theft offense.
