This was kind of mirrored in the Covington Kid lawsuit. The judge dismissed the statements that the kids were racists or whatever. What stuck was the verifiable fact statement that Nick Sandmann was physically impeding the stolen valor injun.
Actually, that makes me wonder. In one of the more recent Texas TCPA cases the appellate panel ruled that the plaintiff only needed one showing of defamation, whereupon they could proceed with their lawsuit (and presumably argue about the other statements in court). In the Sandmann case, since the judge ruled the one statement could be defamatory, could Sandmann have proceeded to try the other statements that were denied in the 12.b.6?

This is purely and entirely off the cuff, but I believe those other statements were dismissed as grounds for defamation, but I believe the plaintiff could raise them as part of the context as to how the other statement was defamatory under the totality of the circumstances. I suppose we'll see how that plays out.
