It's also extremely telling of the relationship between Twitch and game studios. In this instance it was fake but let's say it wasn't and was a real THQ employee. So if a studio doesn't want their game streamed or even has a vendetta against a particular creator, they can just have them suspended? That's bullshit if you ask me.

Well. It all ties into things like online game stores. When you buy the game from Sony’s store or other online stores, technically you don’t buy the actual game, but instead pay for the right to download it and play it.

With games bought online, game developers are perfectly within their rights to prevent you from streaming it, if they so choose.

(I do believe it’s a different matter if you buy a physical copy, but not 100% sure.)

It’s almost as it the faggots that kept railing against online stores and electronic game copies a decade ago had a point.

The whole shtreeming thing comes down to fair use, really. The purchase of a physical copy or a digital copy makes little difference. With both, you're essentially purchasing permission to play what they have made. This is Phil's excuse for being able to get away with skirting fair use (goat laughs and saying "huh-low..." to various NPCs is his art, so to speak). Is his gameplay transformative enough to qualify? I suppose so, but only just barely. Fair use is sticky and the interwebs is still trying to figure out what's OK and what's not.

If all the game makers wanted to crack down on let's plays and streamers, they probably could, but they would be wasting a huge amount of money and time fighting something that amounts to easy advertisement for them.

If you buy strictly digital, the biggest issue you run into is being able to play said games years down the road after those online stores have since closed up or whatever. I can go fetch Perfect Dark for the N64 out of the closet and fire it up any time. But if I only bought it through some digital store, I might not be able to get my turtle sim and peace sim fix.

I would be surprised if he actually got fed up with Twitch and this DMCA stuff if he decides to actually go through with fucking off from it. Right now though, he's really driving the whole Youtube Ranting Switcheroo everytime it happens and taking advantage of receiving money.

If this becomes a routine thing for him, the question is how long can he keep up with the "Twitch bad and I want to speak to the manager" before he actually gets shitcanned?

I think Phil is too lazy/resistant to change to want to follow through on leaving, no matter how much he bitches about Twitch. That's why it took him so long to join Twitch in the first place. He'll only go someplace else if Twitch ever kicks him off.

As for the second part, I can't see him getting shitcanned for this. I don't know exactly how Twitch's customer support works, but it seems like the DMCA stuff is fairly automated. With how quickly Phil gets unbanned, I can't imagine they're doing any real indepth investigating into the claims. I'm guessing some minimum wage tech support person eventually sees a partner has issued a counterclaim or whatever, then they unban the account. It would take someone actually threatening legal action for Twitch to care, and in that situation, I can't see them siding with Phil, since that's one of the few instances where they've kicked off streamers before who were much larger than Phil. Well, in channel size at the very least.

It wasn't until about a year ago that Nintendo didn't allow you to use their games without giving them a cut.

This is why Phil would bitch about Nintendo games so much. If he played one of their games, they would claim it and get the revenue. There were ways around it, you could join their program and you would split the money, but Phil is an all or nothing kind of guy.

There are no clear cut laws about streaming video games and whether or not it is transformative. Any game company could theoretically stop anyone they choose from publicly playing their game.

Examples like when certain companies put embargoes on games. You get your copy early but can't stream it until a certain date. You can stream the game but can't show the ending. Stuff like that.

There are websites like GOG that allow you to download the game and you can keep that wherever you like so you can play it 20 years later if you want,at least you have that option on PC but the game library on GOG is much smaller than on steam and there is no GOG equivalent for consoles so you have to buy physical.

There's actually this documentary called Zoo about the incident. It meanders a lot and doesn't talk about Mr. Hands as much as you'd hope (?). It also spends a lot of time explaining/borderline defending why people become sexually attracted to their horses. The Mr. Hands video itself isn't present in the documentary to any meaningful degree except for some of the audio.
