Which is retarded, since a self defense claim is a affirmative defense. If we entered clown world further, and jump kick guy and Lefty were charged with assault, they could try to make a claim that they attacked Kyle because they feared for their lives.

What doesn't happen is using a affirmative self defense claim, working some retarded voodoo on it, and then transform it into some kind of prosecutorial tool.

Actually, I think it's possible for both parties to claim self defense if they're both alive and both charged.

With Detroit being like other inner cities in that it votes a rather solid blue, anyone with (D) following their name tends to be a shoo-in.

Representative Tlaib is all but assured (re)election because of this as long as she wishes to run, but there's also the fact that the area of Detroit she serves and is from has a large population of latinos, both legal and illegal. She knows what words to say and what boxes to check to successfully appeal to voters in that area. TBH, the Republicans know that she and the Dems have such a stronghold on that seat that they choose not to waste time, money, or promising candidates in what would be futile at best attempts to take that seat.

Those running for local seats such as city council or the school board get those seats largely on name recognition and less on ability to perform their duties. Even those currently serving and doing so incompetently will get reelected easily simply because people know them and their relatives as allegedly influential residents of the city. It's no different than the political machines in other big cities. This may be the biggest concern about Detroit's goals that you're asking about, @Random Internet Person. If these governing bodies start adopting policies that take Detroit backwards in terms of city operations and the public school system, we'll see familiar problems pop up again.

However, not everything about Detroit needs a doompill yet. In a rare lucid moment, Detroit voters helped reelect Kym Worthy for county prosecutor even though she was challenged in the primary by someone who held the same "restorative justice" values we've seen in use by prosecutors in the PNW.

Which would be the best thing that can happen if this goes before a jury. How many crazy gunmen actually run away from their victims, try to avoid them and shoot only when pressed to do so? Merely pointing that out will make that case inflate harder than Dobson's career.

Kyle used his phone after shooting Pedocuck in the dick, I assume to call an ambulance or the cops. Checking the phone company records will be a rather trivial thing and allow his attorney to wipe out any reasonable doubt... well at least amongst those that are reasonable people.

The criminal complaint filed by the prosecutor to support his initial arrest is more than enough to substantiate Kyle's self defense claim. The document as written seems almost like they were putting in writing the justification to decline charging him at all. It's a weirdly uneven document like that.

The additional evidence, testimony, and video gathered by his attorneys is just frosting on the cake. Any attempt to sidestep it and apply special pleading to this case will completely gut self defense and make it de facto illegal to defend yourself from a mob.

In a rational setting, this case would have been unlikely to go to the arrest phase, and never to trial. Unfortunately we are entering into anarcho-tyranny territory so the government has to be weaponized for political purposes.

Don't worry though, destroying people's trust in government and undermining the social contract that maintains civil peace could never end badly.

Yeah, the only reason why I feel slightly afraid Kyle might get unjustifiably punished is him being sentenced by some asshole judge with an agenda...

I mentioned the case of Bikelock Scum earlier, who managed to avoid any kind of appropriate punishment for whatever stupid reason.
That U-Lock wielding fucker went with a slap to the wrist, even though there had been insane levels of evidence (ffs 4chan identified a pen in one of the photos and found private images of him without the mask using said pen!). We've seen people going to jail over smudged footprints of a sock, and that fucker went away scot-free after hitting several people with a steel bikelock with all that stuff backing up his identity as the bikelock attacker.

One just hopes Kyle will get a decent judge and get justice. Furthermore, I hope that he'll be able to sue everyone that dragged him through the mud as well.
Is there any trial against the guy who feigned surrender and tried to shoot him? Afaik, that guy wasn't allowed to own a gun and photos clearly show him holding a pistol. I'd love if that fucker went to jail instead.
 
The phone - he called his friend and said he shot someone. Not police or anything else that I had seen reported. I can follow his logic in doing (city in middle of a riot so emergency services unavailable, finding where his friend was due to still being pursued by armed mob, brain in panic ,mode because "fuck just killed someone.) .Can't see it being a point in his favour but I think trying to use it against him it's going to have lots of reasons why he would call them rather than the police.
The armed fellow - yes has a criminal record but I believe from what I'd seen received reduced sentence of one kind or another (pled guilty, reduced charges for other reason, not up to digging back on the internet right now) so his possession of the gun was fine. I think that the guy who shot in the air when first chasing Kyle was also charged, weeks after Kyle was arrested, since firing your gun off randomly into the air in the middle of a city is massively dip shitty. Being part of a mob chasing someone may escalate things when he gets to trial, who knows.

Iirc the reason people stopped using Wayback was learning that one can petition wayback to not archive the site (aka remove the archive). Least that's what I heard, and is why I don't use it anymore.
Archive.org will not host anything that the owner doesn't want on their servers. You could actually easily abuse their refusal to do so for things you don't want on there, but for news articles I think they'd want an email from the appropriate organization.
You can just edit robots.txt to tell their archive.org crawler to fuck off and I'm surprised most news orgs don't by now.

One of the few things I hate fanfiction.net/AO3 for - robots.txt not allowing me to see fanfic that someone has removed.
