tl;dr they wanted to replay the trial instead of waiting for an appeal, because the jury were mean doodie heads who didn't decide the right way and the plaintiffs are racists and should die already. Now an appeal is their only option.
At least some of their objections to what happened at trial were literally complaining about things that they'd requested themselves.

I have to admit I'm surprised. The only thing I can think of is that they're desperate to avoid having a precedent set against scurrilous, defamatory speech and enabling such.

Hiring 1A specialist lawyers sounds like they might be shifting tactics a bit. Their initial argument was more along the lines of "we didn't really do anything, it was mostly the students, not us". Now it looks more like they're going to try to argue, "Yeah, we did all that shit you say we did, but so what?"

They don't get to appeal the facts as found by the jury, so they have to live with those. Those can only be appealed for being "clearly against the weight of the evidence" and there's not even a joke of an argument in that respect.

So they have to argue the law.

@AnOminous and other lawyers can confirm this further. Often lawyers will tell their clients this. Sometimes beg "I have to go in front of this judge after I am done with your case."
This is going to appeal so it's not going to be the same judge any more.

If they are looking to avoid precedents being set, they should really keep it out of appellate courts, as those are where precedents are set, not lower district courts.

Whatshisname from the UK who tried to have Boris arrested for fraud was strongly advised by his solicitor that he shouldn't go forward with the case, and look where that got him.

Barring that which is illegal or against the ethics of the Bar, a lawyer can only warn their client in good faith they are walking off a cliff, if they're determined to walk off it because they think they somehow have the ability to not fall, there's little they can do except try their best and bill them for the loss.

These people at Oberlin are true believers in the Right Side of History (tm) and do not logically or objectively grade their actions, they are ruled by emotion and an unwarranted sense of importance and ego that tells them it's everyone ELSE whose got it wrong, and all they need are just fancier lawyers, a bigger venue and some more "likes" on social media, and they'll win the day... "legal grounds for appeal?" What's that? Obviously we have rock-solid grounds: We LOST! And we, the progressives, are NOT TO LOSE, EVER in the culture war!

I will cheerfully admit I could be wrong. But this was a losing fight from the get go. Unlike other cases (say, Vic), they had the school dead to rights; members of the administration actively assisting with the protests, posters printed using university assets, etc.

Why they didn't quietly settle is beyond me, other than the SJW mindset of 'we are good, therefore they are evil, and we cannot lose'.
