Well, Ty told them there were others, and offered to show him in his filing, but Chupp said no, show me in the other side's "courtesy copy" that wasn't even in the file and they weren't provided a copy of, and simply refused even to look at it even though presumably he should have already read it.
To be clear, I think what actually happened is that Beard brought up one con (KamehaCon?) and tried to give Chupp-meister a binder. Clown-in-robes refused it, and asked for details on how much he lost at that con and Beard did not know the answer off the top of his head, and offered to get it. That really seemed to offend His Honourable Flatulency, and he said something to the effect of: 'Well if you don't have any other evidence...' and 'He to go tho...'

He tried to point out in a document he had already submitted, and that was already in the record, in response to Chupp's question, that yes, there were other cons. Chupp said he already had Lemongrab's folder (not even in the record). He was not trying to submit material outside the record.

My understanding was that the binder was a condensed 'picture-book version' of what they had submitted in the record to make it easier to read/process/reference. Could be wrong...

Nick's read was that Ty was caught off-guard by the Chupp-ery and lost the initiative in that exchange--having counted on having the handy reference in Chumpers grubby hands. I want to believe that, but there is enough 'tism and blame to go around in this clusterf*ck of legal proceeding.

This is why you should go over every page of every filing before it goes out, making sure that every single factual assertion directly cites to the record in a parenthetical immediately after the assertion. In this case, Chupp through out tortious interference with existing contract because there was only one, which is nonsensical. He was demanding evidence of something that wasn't even required or being sued over.

Not only that, but Chupp also dismissed the idea that KamehaCon even counted since Vic got re-invited. Nevermind the fact that he had to pay his lawyer to negotiate the re-invite, and the new contract was worse than the original one (they took away his prime location with the other VAs and made him hire more security). There were tangible, definite damages.

Chupp's a fucking retard. It's like dismissing an attempted murder charge because the guy got better. So what if he had medical bills and had his leg amputated below the knee, he's not dead is he? I guess he wasn't harmed then.

This is why a competent judge, as opposed to a 🤡 🌎 judge, rarely if ever makes a snap ruling on a dispositive motion from the bench, even if it looks like a no-brainer to them at the time. Even if the lawyers on one side or both sides put on an absolute clownshoes performance (which Ty really did not even though he was on his back foot for much of the hearing), a look at the record in light of the arguments could always help in getting it right.
