If you really think about it, Brianna should be paying Jan for this whole debacle. She was fading into obscurity faster than she could keep up with before Jace arrived on the scene with his Prius and thirst for street justice. Jace provided her the enemy she had been yearning for (as Hotwheels diligently ignored her and Gamergate is leaderless) and she took full advantage of it, constantly posting about contacting politicians and filing restraining orders on her Twitter while her butt buddies at Jezebel and the like churned out articles about how LITERALLY SCARED FOR HER LIFE Brianna was, and oh can you please check out her Patreon?

There's really not all that much speculation to make. Any suit would sound in tort. There are a limited number of tort causes of action that make any sense for the conduct at issue.
Assault is right out: any of his threats fail the imminence element. Battery as well: no physical contact was made. Negligence-based torts are unlikely: I don't think there's any reason by which you could argue Jan had a "duty" to not say unkind things to Wu. Defamation is a possibility: Wu can claim that being called a transexual is defamatory... except Jan would be able to try and prove the truth of the statement in his defense... so yeah probably not a good idea.
The most likely cause of action that Wu would try is intentional infliction of emotional distress. Unfortunately for Wu, the case law on that tort makes it astoundingly unlikely that she would prevail. And I mean astoundingly unlikely. It's sometimes shocking the factual situations that have failed to succeed in IIED cases. I'm not entirely clear on Mass. case law for IIED, but I seriously doubt it's any different. The element that usually is not satisfied is that the conduct has to be "extreme or outrageous." Fortunately for Jan, the people who have to determine whether conduct is "extreme or outrageous" are generally not Tumblr users or Ghazi posters.
This quote makes it pretty clear that Wu is bucking for an IIED claim. Causation is important, but the fun part is going to be that Jan will be able to muddy the living hell out of the waters by showing all the other "threats" that Wu has received, and Wu's historical reactions. Even if Wu could win on the "extreme or outrageous" element, she would probably be unable to sufficiently prove causation, thanks to her victimization behavior.

Goddamn it. Can't the media (and I use the term loosely regarding Jezebel) just realize that s/he is an attention whore and will do anything for those sweet, sweet patreon bucks?
